Exodus 21:1-11 Laws about Slavery

OPENING

Look at this poster. I bought this when my children were much younger. This used to be our “Family Rules” poster. We kept it on the balcony door for several years. Some of the rules included: “Say please and thank you”; “Say I love you”; “Keep your promises,” etc. What do you think was the most important rule in my family? The most important rule was: “Listen to your parents!”

Families or communities have rules. Without rules and laws, communities, societies, and nations cannot sustain themselves.

CONTEXT

In Exod 20, God gave Israel the Ten Commandments. And in Exod 21, he is also giving them additional laws. Why does God give Israel the law? He does so because Israel is God’s chosen people and holy nation. God is inviting Israel into a very special covenant relationship and giving the law so that they may live as the holy people of a holy God.

We will look at some of these additional laws in Exod 21–23, a section known as the “Covenant Code” or “Book of the Covenant.” And these additional laws in these chapters cover a wide range of subjects including slavery, personal injuries, property, social justice, etc.

TEXT

Let us read the very first law that God gave Israel after the Ten Commandments: 21:2 When you buy a Hebrew slave, he shall serve six years, and in the seventh he shall go out free, for nothing.

Were you surprised? I am asking this because, when people read this verse, their normal response is, “Wait a minute. Couldn’t he talk about something else as the first law, such as love, honesty, or justice? Why does he have to discuss slavery at the outset of his laws? Weren’t they just rescued from slavery in Egypt? Was there slavery among the Israelites? How was it possible?”

Some people simply assume that God promoted slavery among his people. It’s not true at all. So, what’s going on? In ancient cultures, slavery was a way of life. The ideal of “freedom for all men” didn’t exist in the ancient world, nor does it fully exist in today’s world. Thus, slavery was a widespread social system both in Israel and in other parts of the world.

Then how did one become a slave? Even though the Bible says, “When you buy a Hebrew slave,” it does not mean that there was a slave market within Israel, where people could buy or sell slaves. Ancient slavery was often a form of “debt slavery.” Many people found themselves in debt because of the unpredictable and harsh conditions of the ancient Near Eastern environment. For example, if you were a farmer and there was a severe drought, you would have poor harvests. You would then be forced to sell your land and property. Then you would be forced to sell members of your own family. Finally, you would end up having to sell yourself. So, the meaning of “When you buy a Hebrew slave” is “when you acquire a Hebrew slave.” This was how people ended up becoming slaves. Once again, in ancient cultures, slavery was a way of life, and Israel was no exception.

What was the first law God gave regarding slaves? 2 When you buy a Hebrew slave, he shall serve six years, and in the seventh he shall go out free, for nothing.

God established a clear time limit: no one could own a slave for more than six years; in the seventh year, the master had to set the slave free. But there were two types of cases.

First, if a person became a slave while single, he was allowed to go free in the seventh year; and if a married man with his family became slaves, he and his family were likewise set free in the seventh year (v. 3).

Second, however, if a person became a slave while single, and his master gave him a wife, and he built a family during his period of servitude, then in the seventh year he was allowed to go free, but his family had to remain because they belonged to the master (v. 4).

In this case, the enslaved man had two options. First, he could go free alone and gain his freedom—but he would need to leave his family. Second, he could remain with his family, but he would have to remain a slave.

This is a tough decision, isn’t it? So please put yourselves in this man’s situation and think about what decision you would make. Would you leave alone and become free? Or would you stay with your family in your master’s house?

Some would choose the first option, and some would choose the second one. If you choose the second option and decide to stay with your family, the master will leave a mark on your ear, and you will be his slave forever (v. 6).

There was another category of slave. Selling children into slavery because of extreme poverty was quite common throughout Mesopotamia, and Israel was no exception. In vv. 7–11, God gives case law concerning a man who sells his daughter into slavery.

Surprisingly, these female slaves were not allowed to go free in the seventh year (v. 7). So, the rule in v. 2 did not apply to female slaves. However, there was one condition: if the master had taken her as his wife, then she was not to be set free in the seventh year. But if he had not taken her as his wife, she was free to go.

Furthermore, God did not permit masters to sell their female slaves to a foreign people because the pagan nations did not have a comparable law requiring the release of slaves in the seventh year.

And if the master had given the female slave to his son as his wife, God commanded that she be treated as the master’s daughter-in-law rather than as a slave (v. 9). Finally, if the son had taken another wife, God commanded the master’s son to continue providing her with food, clothing, and marital rights. If the master’s son failed to do so, God commanded that she be set free (vv. 10–11).

APPLICATIONS

Are you still surprised because God does not command Israel to abolish slavery but instead gives laws on how to regulate it? You may not be alone. Many people—including both Christians and non-Christians—criticize God for permitting (or even directly legislating) slavery in the Bible.

Please remember that God met Israel where they were. Israel was a sinful community, no better than the surrounding pagan nations. It was entirely by God’s grace that they entered into a covenant relationship with him, not because they were good enough to be chosen. As God’s chosen nation, Israel shouldn’t have practiced slavery. Nevertheless, slavery existed even within Israel because the Israelites were sinners like those of the surrounding nations. So, Exod 21 is not promoting slavery at all; it simply shows us that Israel also practiced slavery.

So, a remarkable thing in Exod 21 is that God enters their broken world and teaches Israel how to embody his mercy in everyday life. Rather than abolishing slavery immediately, he established laws that humanized the wicked system.

For example, God’s laws commanded the Israelites to show compassion toward slaves, especially toward female slaves: (1) God commanded the Israelites to treat slaves as fellow human beings; (2) slaves were to be released in the seventh year; (3) slaves had the right to Sabbath rest; (4) God prohibited the Israelites from selling Hebrew slaves to pagan nations because such slaves would not have received protection there; (5) if the master had not taken the female slave as a wife, she was permitted to go free in the seventh year; (6) the master was required to care for the female slave.

How about in the New Testament? The apostle Paul urges Philemon, the slave master, to receive his runaway slave, Onesimus, “no longer as a slave but . . . as a beloved brother” (Philemon 16).

The law of God was much more than the list of do’s and don’ts. It revealed God’s righteous and merciful character. So, what does God’s law concerning slaves reveal about him?

First, it reveals that our God is a God of mercy, whose heart is full of compassion for the weak and the oppressed.

Second, God is not pleased with slavery. Yet he did not choose to overthrow that system overnight. Instead, God taught his people to live as his holy people in the midst of a broken world and sinful culture—they were called to reflect God’s righteousness and mercy here and now. In the same way, in the midst of today’s broken world and sinful culture, God has called each of us to live in a way that reflects his love and mercy to those around us, especially to the poor, the weak, and the vulnerable.

CLOSING

In Gal 3:28, the apostle Paul declares: There is neither Jew nor Greek, there is neither slave nor free, there is no male and female, for you are all one in Christ Jesus.

Think about this for a moment, and you will see just how shockingly revolutionary this really is. The ancient world was deeply divided by race, social status, wealth, and gender. Slaves and women had little dignity and were despised. Yet Exod 21 reveals that God sees them and cares for them.

And in Galatians, Paul declares that every believer stands on equal ground before God because we are all found in Christ Jesus. This is possible because, in Christ, God’s mercy has been revealed to us in its fullest expression; we were all once slaves to sin and death, but God sent his Son to pay the price for our sins with his own blood. Through Christ, we have been set free from slavery and become children of God; God has given us a new identity in Christ.

This is why we too are called to reflect God’s mercy and Christ’s love in today’s broken world. Wherever God has placed us—in our homes, workplaces, schools, or neighborhoods—we are to treat every person with the dignity, compassion, and love that Christ has shown us.

Our God is a God of mercy. He has fully revealed his saving mercy in Christ Jesus. And because we are in Christ, there is neither slave nor free, neither male nor female.
